Round-up: Appeals Court Upholds Pause on Student Loan Relief Plan - December 1, 2022

The U.S. Court of Appeals for the 5th Circuit in Texas has rejected the Education Department’s request to lift the injunction issued by a federal judge in Texas freezing  President Biden’s student loan relief plan. 
 
The decision follows U.S. District Judge Mark T. Pittman’s opinion declaring the plan unconstitutional.  The ruling upholds Pittman’s order while the court considers the merits of the Biden Administration’s appeal. The court indicated it would expedite the matter.
 
Yesterday’s ruling is the latest legal setback for the relief plan. The Biden administration already has asked the Supreme Court to intervene in that case before the U.S. Court of Appeals for the 8th Circuit and reinstate the program.
 
The student loan relief plan would have cancelled up to $20,000 in federal student debt for more than 40 million Americans. Some 26 million student loan borrowers had applied for the plan with 16 million approved before the judge’s order to freeze the plan.
