Gainful Employment Delayed Until At Least July 2019

The Trump Administration has once again delayed public reporting requirements for covered gainful employment programs. Nonprofit colleges and universities offering Title IV-eligible certificate programs will not need to publicly disclose debt-to-earnings or employment rates on their website or in promotional materials for the 2017-18 academic year.  Accordingly, the Department of Education will not sanction any program failing the metrics established by the Obama-era rules.
 
This further delay means institutions will not need to report on their gainful employment programs until July 2019, at the earliest. The Department’s justification for the delay stems from its pending complete rewrite of the existing gainful employment regulations, which concluded negotiated rulemaking in March 2018. The timeline on the release of the amended gainful employment final regulations remains unclear at the present time. 
 
In 2016, colleges and universities were required to report and publish their gainful employment statistics via the Department of Education’s gainful employment template. Last year, however, the Trump Administration suspended the reporting requirements shortly before announcing its intention to completely rewrite both the gainful employment and borrower defenses to repayment regulations.
