Higher Education Community Responds to Proposed Title IX Rule

The American Council on Education, in conjunction with 61 other higher education associations including NAICU, submitted comments on the Department of Education’s proposed rule on Title IX.  The 33-page letter was the result of extensive collaboration by a team of Title IX experts, including NAICU staff, and was designed to reflect the common views of a broad and diverse set of higher education institutions.
 
The letter reaffirms the responsibilities of colleges and universities to respond to allegations of sexual harassment, including assault; notes where the higher education community believes the proposed rule would help institutions better fulfill those responsibilities; and identifies and describes areas where changes in the rule are needed to achieve these objectives.
 
The Department of Education received approximately 100,000 public comments on the draft rule, which will be reviewed and considered before a final rule is issued.  It is not clear how long this next step will take and when a final rule will be published.
