Negotiated Rulemaking Underway
This week marked the beginning of the Department of Education’s negotiated rulemaking session to assess modifying regulations pertaining to student aid programs.
One of the committee’s first actions was a proposal to add two additional students as negotiators and a third student as a non-voting advisor. However, negotiators could not come to consensus on the proposal and, therefore, the additional students were not added to the committee.
The committee has been discussing the topics that will be covered during negotiated rulemaking and taking consensus checks on these topics to get a sense of where negotiators are on the issues. The issues that have had the most robust conversation have been borrower defense, closed school discharges, and the public service loan forgiveness program.
The committee will reconvene on November 1st for its second session. Any updates regarding the topics of discussion for the committee, as well as the proposals the Department put forward this week, can be found on the Department’s negotiated rulemaking for higher education webpage.
