Round-up: Biden Administration Rule Prohibits Blanket Bans on Transgender Athletes - April 10, 2023

April 10, 2023

Transgender athletes can be excluded from competitions if necessary to maintain a level playing field, but wholesale bans in college, elementary and secondary school athletics would be prohibited under a new rule proposed April 6 by the Biden administration.

The proposed regulation prohibits schools from adopting “one-size-fits-all” policies that categorically ban transgender students from participating on teams consistent with their gender identity. But schools would have the ability to develop team-eligibility criteria that ensure fairness in competition or prevent sports-related injury.

The new federal rule is an attempt to clarify how Title IX regulations should apply to transgender athletes in college and K-12 sports.
