Title IX Regulations Update


The Education Department issued new guidance on July 20, 2021 for how colleges should investigate sexual misconduct under Title IX.

The question-and-answer document offers new interpretations for rules issued one year ago by former Education Secretary Betsy DeVos.

Observers believe the guidance is a stopgap measure, indicating how federal officials will enforce Title IX while the Education Department formally reviews and revises the regulations.

Former U.S. Secretary of Education Betsy DeVos issued a long-anticipated 2,033 page rewrite of Title IX regulations on May 6, 2020. The final Title IX regulations govern sexual harassment policies, including sexual assault, on college campuses. Colleges and university had until August 14, 2020 to begin implementing the Trump era rules.
