Round-up: Education Department Issues Final Title IX Rules

U.S. Secretary of Education Betsy DeVos claims to have strengthened protections for survivors of sexual misconduct and restored due process in campus proceedings in a 2,033 page rewrite of the Title IX regulations issued May 6.  The Department's final Title IX regulations redefine sexual harassment, including sexual assault, as unlawful sex discrimination. The Education Department expects the new Title IX regulations to hold schools accountable for failure to respond equitably and promptly to sexual misconduct incidents and ensures a more reliable adjudication process that is fair to all students. The new regulation comes after three years of study, more than 124,000 public comments. Colleges and university have until August 14, 2020 to begin implementing the new rules.
 
In a statement issued to the media, NAICU President Barbara K. Mistick, D.M., said:  “College and university leaders are committed to providing a safe environment and fairness to all students.  However, in the best of times, it would be extremely difficult for colleges and universities to implement this wholesale change in rules and procedures in less than three months.  In the middle of a global pandemic and national economic collapse, when higher education leaders must be singularly focused on the health and safety of their students and campus communities and the survival of their institutions, this wholesale change is unconscionable.”
